DAY TOUR TERMS & CONDITIONS

PAYMENT
Upon confirmation of your booking with Hua Hin Bike Tours by Adventure Cycling Thailand (ACT), you are required to make a deposit payment to Adventure Cycling Thailand within 24 hours. The remaining balance of the tour cost can be settled in cash upon meeting the ACT Staff. Failure to remit the deposit within the stipulated time will result in the non-confirmation of your booking, consequently rendering the tour/date available to other prospective customers.
TOUR INCLUSIONS
Every Adventure Cycling Thailand tour encompasses various services, including activities, meals, snacks, beverages, and transportation. Comprehensive details regarding these inclusions are provided on each tour page of our official website, www.adventurecyclingthailand.com. Adventure Cycling Thailand reserves the right to modify the listed inclusions due to operational requirements or other pertinent factors.
CANCELLATION POLICY & RAIN

Adventure Cycling Thailand maintains a policy of rarely cancelling tours, regardless of weather conditions. Please note that tours will not be cancelled due to rain. It’s important to understand that weather forecasts predicting rain or current rainy conditions do not necessarily signify tour cancellation. Rainfall in one area does not necessarily indicate rain in the tour route, and weather conditions can change rapidly.

When queried about the impact of rain, our response typically remains, “We might get wet.” We do not provide specific rain gear for cycling and discourage its use. While we do have a limited stock of disposable rain ponchos available for purchase, we advise against them due to environmental concerns and potential discomfort caused by heat. In the event of rain, Adventure Cycling Thailand may propose a delay of up to one hour before commencing the ride. If heavy rainfall persists and visibility for other vehicles is compromised, we will opt to wait until the rain diminishes. Additionally, in cases where lightning and thunder indicate proximity of lightning strikes, we will seek shelter until the storm passes.

It’s worth noting that rain encounters during our day tours are exceedingly rare, accounting for less than one percent of occurrences. During the “Green Season,” commonly referred to as the rainy season, rainfall typically occurs later in the day for brief periods, contributing to cooler evenings ideal for dining outings.

CANCELLATION BY YOU

In the event that you, the client, wish to cancel a booking, Adventure Cycling Thailand requires notification in person, via phone call, or through email communication.

  • Cancellation fees for our Day Tours are as follows:
  • More than 3 days before departure: Full refund or credit, depending on losses incurred by ACT.
  • Within 72 hours of departure: Loss of deposit.
  • Late arrival at the tour starting point, regardless of reason, is deemed a late cancellation and will result in forfeiture of all payments made.
  • No refund will be issued if you choose to depart the tour prematurely for any reason, including insufficient cycling ability to participate at the required level.
  • Please note that in certain instances, the deposit may equal the full value of the tour.
HELMETS
As a safety measure, all cyclists participating in any Adventure Cycling Thailand bicycle tour/event are required to wear a bicycle helmet while riding. Failure to adhere to this requirement will result in the individual being unable to participate in the cycling portion of the tour program.
LIABILITY FOR BICYCLES & EQUIPMENT
Adventure Cycling Thailand places a high priority on the proper care and use of bicycles, E-bikes, and all tour equipment provided to our customers. It is essential to adhere to safety guidelines and operational instructions at all times.

In the event of loss or damage to bikes, E-bikes, and/or other tour equipment due to improper use or failure to follow safety and operational instructions, the customer will be held liable. Charges equivalent to the repair or replacement costs will be incurred by the customer in such instances.

It is imperative that all customers exercise due diligence and responsibility in handling and using the provided equipment to ensure the safety of themselves and others, as well as the preservation of the integrity of the equipment.

ITINERARIES
Adventure Cycling Thailand retains the authority to modify advertised itineraries either prior to or during a tour, prioritizing safety considerations arising from factors such as war, disease, natural disasters, safety concerns, or altered local conditions. The tour leader or guide possesses the discretion to implement necessary alterations to the itinerary for the aforementioned reasons. Clients who fail to comply with these modifications will be considered to have withdrawn from the tour and will no longer be under the supervision of Adventure Cycling Thailand.
INSURANCE
As a prerequisite for participation in all Adventure Cycling Thailand multi-day tours, charity rides, and other ACT events, each traveler is required to hold their own travel insurance. For our day tours, basic medical insurance is included, thus alleviating the necessity for travelers to procure additional coverage for these specific outings. However, in the event of injury or the need for medical attention during a day tour, ACT may inquire about the presence of travel insurance. This inquiry is aimed at affording individuals the opportunity to seek treatment at an International Standard Private Hospital, with associated expenses covered by their travel insurer, as an alternative to local Thai Government hospitals.
PERSONAL RESPONSIBILITIES
Given the distinctive style and diverse locales inherent in Adventure Cycling Thailand’s operations, it is imperative to acknowledge that Adventure Cycling Thailand, along with its guides, leaders, and support staff, cannot assume responsibility for any loss, injury, illness, damage, accident, fatality, delay, or inconvenience incurred during the period spanning from departure to return on any adventure trip organized and executed by Adventure Cycling Thailand.

Booking Terms and Conditions
Thank you for considering Adventure Cycling Thailand for your upcoming adventure. Before proceeding with your booking, we kindly request that you carefully review the following Booking Terms and Conditions. Your booking with Adventure Cycling Thailand signifies your understanding of and agreement to these Terms and Conditions, as well as any additional terms and conditions specified at the time of booking.
1. OUR CONTRACT

In these Booking Terms and Conditions, references to “ACT” denote Adventure Cycling Thailand as outlined above. These Booking Terms and Conditions govern all bookings made with ACT agents or consultants (whether over the phone, in person, or via email), as well as online bookings conducted on our ACT website. By engaging in a booking with ACT, you signify your acceptance of these Booking Terms and Conditions, thereby establishing a contractual relationship between Adventure Cycling Thailand and yourself.

ACT will place reliance on the authority vested in the individual making the booking to act on behalf of any additional travelers listed on the booking. It is understood that said individual will bind all accompanying travelers to these Booking Terms and Conditions.

In the event of a conflict between these Booking Terms and Conditions and any other agreement between you and Adventure Cycling Thailand, the provisions of such other agreement shall take precedence over these Booking Terms and Conditions.

2. BOOKING AND DEPOSIT

To secure your booking for multi-day tours with Adventure Cycling Thailand (ACT), you are typically required to make a deposit of 50% of the total tour cost, inclusive of any additional fees such as Single Supplement or E-Bike upgrades, unless otherwise instructed by ACT or your designated agent prior to booking.

Please note that, in accordance with applicable consumer laws, this deposit is generally non-refundable unless ACT cancels your tour.

3. ACCEPTANCE OF BOOKING AND FINAL PAYMENT

Upon acceptance of your booking by Adventure Cycling Thailand (ACT), a confirmation will be issued. A contractual agreement between you and ACT will be established as of the date ACT issues the confirmation invoice. In the event that you book within 45 days of departure, the contract will come into effect upon ACT’s acceptance of your payment.

Full payment for your selected tour or services is required at least 45 days prior to your departure date. Failure to make the full payment by this deadline may result in the cancellation of your booking by ACT. Special offers may necessitate full payment by an earlier specified deadline, as outlined in the offer details. For comprehensive information regarding final payments, kindly refer to your booking confirmation.

4. PRICES AND SURCHARGES

All prices listed are in Thai Baht (THB) unless stated otherwise. It is important to acknowledge that the quoted prices are subject to availability and may be withdrawn or modified without prior notice. The price becomes binding only upon full payment by you and the issuance of confirmation by ACT.

Please be aware that price adjustments may occur due to factors beyond our control, resulting in increased costs for the services provided by ACT or arranged on your behalf. Such factors may include adverse currency fluctuations, elevated fuel expenses, taxes, and accommodation rate hikes.

In the event that a surcharge leads to an increase exceeding 10% of the trip price, you reserve the right to cancel the booking within 14 days of being notified of the surcharge and receive a full refund.

5. CANCELLATIONS BY YOU

In the event of a cancellation of some or all portions of your booking, cancellation fees will be incurred. It is imperative that any cancellation by you be communicated in writing, as Adventure Cycling Thailand (ACT) will only process cancellations upon receipt of written notice.

  • For Multi-Day Bike Tours, and in accordance with applicable consumer laws, the following cancellation policy applies:
  • 45 days or more prior to departure: Deposit held as ACT Credit.
  • 30-44 days prior to departure: 50% cancellation fee, with 50% held as ACT Credit.
  • 8-29 days prior to departure: 75% cancellation fee, with 25% held as ACT Credit.
  • 7 days prior to departure: No refunds or credits will be issued.

ACT Credit constitutes a voucher equivalent to payments made by you to Adventure Cycling Thailand. This credit must be utilized within twenty-four (24) months of your cancellation for any Adventure Cycling Thailand tours, services, or products. It is transferable to a friend once, but subsequent transfers are not permitted. Should you opt to redeem your credit for a trip of higher value, any outstanding balance must be settled at the time of booking. ACT Credits are non-refundable and cannot be exchanged for cash.

Please be advised that any fees, charges, or other costs incurred by your bank or financial institution in relation to our refunding of payments are solely your responsibility, and ACT assumes no liability for such expenses.

We strongly recommend obtaining travel insurance, inclusive of cancellation coverage, at the time of booking to safeguard against cancellation fees. Should you depart a trip for any reason after its commencement, ACT is not obligated to issue refunds or provide credit for unused services (subject to applicable consumer laws). Failure to join a tour, joining it after departure, or leaving it prior to completion will result in no refund or credit being available (subject to applicable consumer laws).

6. BOOKING AMENDMENTS BY YOU

Should you wish to make any changes to your booking, including but not limited to switching to a different trip, it is imperative that you notify Adventure Cycling Thailand (ACT) in writing at least 45 days prior to the proposed departure date. Please be advised that if amendments are made 44 days or less prior to departure for Multi-Day Bike Tours, the cancellation conditions outlined earlier will apply.

While ACT endeavors to accommodate your requested changes, feasibility is contingent upon availability and may be subject to additional costs associated with the new travel date. Any supplementary costs arising from amendments to your booking must be settled within seven days of the invoice date or on the date of departure, whichever is earlier. It’s important to note that certain arrangements cannot be modified and will incur a 100% cancellation charge.

You may opt to transfer your booking to another individual who meets all conditions applicable to the trip. A transfer request must be submitted in writing no later than seven days prior to the departure date and must include evidence of acceptance of the transfer by the new traveler. Both you and the new traveler will remain jointly liable for any applicable charges imposed by travel service providers (including, but not limited to, airfares, train tickets, specifically allocated accommodations, and non-refundable supplier charges). Please be aware that certain third-party travel service providers may decline such requests and treat the transfer as a cancellation and rebooking process.

7. CANCELLATION BY ACT DUE TO UNAVOIDABLE OR EXTRAORDINARY CIRCUMSTANCES

Adventure Cycling Thailand (ACT) reserves the right to cancel a trip at any time prior to departure due to unavoidable or extraordinary circumstances, or if the minimum number of travelers required for a tour or excursion is not met.

In these Booking Terms and Conditions, “unavoidable or extraordinary circumstances” refer to any cause beyond our reasonable control that could not have been prevented or avoided, even with all reasonable measures taken by ACT. Such circumstances may include, but are not limited to, war, threat of war, civil unrest, industrial disputes, terrorist activity and its consequences, epidemics, pandemics, infectious disease outbreaks, natural disasters, adverse weather conditions, closed or congested transportation hubs, technical problems with transport, changes to immigration laws, and similar events.

If a trip is cancelled due to unavoidable or extraordinary circumstances, ACT will first offer alternative travel arrangements of comparable standard (with any price difference refunded if the alternative is of lower value), or an ACT Credit for the full amount paid by you. Alternatively, a refund of all money paid by you in respect of the trip (excluding flights and/or insurance, which have their own booking terms and conditions), minus any unrecoverable costs, can be provided.

In the event of cancellation after the trip has commenced, ACT will offer alternative travel arrangements or a pro-rata ACT credit for the remaining days of the trip, if available. Alternatively, a refund of all money paid by you in respect of the trip (excluding flights and/or insurance), minus any unrecoverable costs, can be provided.

“Unrecoverable costs” include all reasonable and direct costs incurred by ACT related to your trip, as well as amounts paid to other relevant suppliers responsible for parts of your travel arrangements.

Please note that ACT is not responsible for any incidental expenses incurred by you, such as visa fees, vaccinations, travel insurance excess, or non-refundable flights.

8. CANCELLATION BY ACT DUE TO GROUP SIZE

While every effort is made to ensure the operation of all trips as advertised, it is essential to understand that our trips are meticulously planned up to 2 years in advance. Each trip requires a minimum number of participants as specified in the tour description.

In the event that insufficient bookings have been secured at least 90 days prior to departure, Adventure Cycling Thailand (ACT) reserves the right, at our absolute discretion, to either cancel the scheduled trip or proceed with the trip below the minimum number of passengers required. We strongly advise against booking flights until your trip is guaranteed.

If a trip is cancelled due to the minimum group size not being met, ACT will prioritize offering alternative travel arrangements for a tour that is guaranteed to depart and of comparable standard, if available. Any price difference will be refunded if the alternative is of lower value. Alternatively, an Adventure Cycling Thailand travel credit for future travel, equivalent to the full amount paid by you to ACT, can be provided. Refunds for any payments made to ACT in respect of the trip will be issued through the same method used for the initial payment.

9. MODIFICATIONS BY ACT

While Adventure Cycling Thailand (ACT) endeavors to deliver all tours as advertised, external factors may occasionally necessitate the use of alternative accommodations and services. ACT reserves the right to modify any tour, accommodation, or arrangement at its discretion. In the event of a material modification being made prior to departure, ACT will promptly notify you, provided there is sufficient time before departure.

If a material modification is made more than 13 days prior to departure, you have the following options:
(a) Accept the modification and proceed with the amended services or accommodations.
(b) Opt for another service of equivalent or similar value, if available, with any price difference being your responsibility.
(c) Choose a service of lesser value, if available, and receive a refund of the price difference.
(d) Accept an alternative tour offered by ACT.
(e) Cancel your booking with a full refund of all payments made or receive an ACT Credit for future use, at our discretion.

You are required to notify ACT of your choice within seven days of receiving notice; failure to do so will be deemed as acceptance of the material modification.

ACT also reserves the right to adjust an itinerary post-departure due to local circumstances or events beyond our control. Any additional costs incurred due to necessary itinerary alterations will be your responsibility, with no further compensation provided.

A material modification is one that significantly impacts your trip, such as a change in departure date, departure point, or airport, or a departure time change exceeding twelve hours. Changes to accommodation or transportation type, size, method, or style are not considered material modifications. For instance, ACT may alter or substitute transportation depending on passenger numbers, with some trips possibly utilizing public transport due to local regulations governing drivers’ hours.

10. SUPPLIER CHANGE AND CANCELLATION FEES

Cancelled bookings may incur supplier fees, which can amount to 100% of the total booking value, irrespective of whether travel has commenced. Additionally, supplier fees may apply in cases of booking changes or when tickets/documents require re-issuance. If Adventure Cycling Thailand (ACT) becomes liable for a supplier cancellation fee due to changes or cancellations made by you, you agree to indemnify ACT for the corresponding amount.

In situations where you request a refund for a cancelled booking for which payment has been remitted to the supplier, ACT will withhold the refund until the funds are received from the supplier. This process may take up to 12 weeks or longer, depending on the supplier’s processing time. Should ACT still hold the funds, a refund will only be processed once authorized by the travel service provider, in accordance with their change or cancellation policy.

11. SPECIAL REQUESTS
Please inform Adventure Cycling Thailand (ACT) at the time of booking if you have any special requests, such as ground floor accommodation, disability access, or specific dietary requirements. While ACT endeavors to accommodate all requests, we cannot guarantee fulfillment and assume no responsibility for unmet requests. In cases where ACT deems it unable to accommodate your special requests, we reserve the right to decline the booking or request that you be accompanied by a person (at your expense) who can provide full assistance throughout your tour.
12. ITINERARY EXCLUSIONS
Please be aware that unless explicitly stated otherwise in your itinerary, certain elements such as airfares, airport transfers, departure taxes, early/late hotel check-ins, gratuities, personal expenses, and some meals are not included in the tour price. Adventure Cycling Thailand (ACT) is pleased to offer quotations for additional services such as airport transfers, early check-in, or any other supplementary requirements you may have.
13. VACCINATIONS
It is imperative that you acquaint yourself with any health prerequisites and recommended precautions pertinent to your travel, and ensure that you possess all requisite vaccination documentation. Failure to present mandatory vaccination documentation, such as proof of Yellow Fever vaccination, in certain instances may result in denial of entry into a country. Adventure Cycling Thailand (ACT) strongly advises consulting with your local doctor, travel medical service, or specialist vaccination clinic prior to embarking on your tour.
14. TRAVEL INSURANCE

It is mandatory for all travelers to procure travel insurance at the time of booking. Your insurance coverage must encompass personal accident, injury, death, emergency repatriation, and medical expenses, with a recommended minimum coverage of $200,000 USD for each category. Adventure Cycling Thailand (ACT) also strongly advises inclusion of coverage for cancellation, curtailment, personal liability, and loss of luggage. Insurance policies provided by credit card companies or reciprocal medical cover agreements often lack comprehensive coverage. It is your responsibility to ensure that you carry insurance documents when traveling, including policy number and emergency contact information. You must ensure that your coverage is sufficient and complies with the terms of the applicable insurance plans.

In the event that you file a claim against ACT, you agree to assign to ACT or our insurers any rights to take action against any third-party service provider, tour operator, or any other party that may have contributed to the claim. You are required to fully cooperate with ACT or our insurers should they wish to enforce the assigned rights. If you file a claim against ACT covered by your insurance policy, you agree to pursue the claim through your insurer either in addition to, or instead of, your claim against ACT. ACT agrees to indemnify you for reasonable expenses incurred in successfully pursuing such a claim, and acknowledges that any settlement made by the insurer shall not prejudice your rights against ACT.

15. TRAVEL DOCUMENTS, PASSPORTS & VISAS

It is imperative that all travelers meticulously review their travel documentation to verify the accuracy of names, dates, and timings. Upon receipt of your invoice and all related documents from Adventure Cycling Thailand (ACT), please carefully review them and promptly notify ACT of any discrepancies. Failure to provide requested details may result in additional charges or the non-refundable cancellation of your trip, in accordance with applicable consumer laws.

Travel documents encompass various items such as airline tickets, hotel vouchers, tour vouchers, or any other document used to confirm arrangements with service providers. These documents may be subject to certain conditions and restrictions, including non-refundability, non-date-changeability, and cancellation or amendment fees. It is important to note that travel documents are non-transferable.

All travelers are required to possess a valid passport for international travel, with many countries mandating at least six months’ validity from the date of return. Additionally, some countries necessitate a machine-readable passport. It is your responsibility to ensure that your passports, visas, and re-entry permits meet the requirements of immigration and other government authorities. Any fines, penalties, payments, or expenditures resulting from inadequate documentation will be solely your responsibility, except to the extent caused by our negligence. ACT will not be held liable if you are denied entry to a country due to insufficient documentation.

16. CUSTOMER DETAILS

You are required to furnish Adventure Cycling Thailand (ACT) with all necessary information in the manner and timeframe specified by ACT. It is imperative that all provided information is accurate and truthful. This includes, but is not limited to, details such as traveler height, weight, age, date of birth, passport nationality, passport number, or any other information deemed necessary by ACT for the smooth operation of the tour.

Any discrepancies in the information provided to ACT may impede your ability to utilize our services, potentially resulting in your inability to join a tour altogether. In the event of issues arising from the provision of incorrect or inaccurate information by you, any additional costs incurred to rectify the situation will be your sole responsibility.

For instance, failure to provide your full name as requested by ACT may prevent you from boarding a flight as per the planned itinerary. Consequently, you would be accountable for arranging an alternative flight and any additional services required to rejoin the tour. Moreover, any subsequent services needed, including meals and accommodation, shall be borne by you. If you are unable to participate in a tour or any part thereof due to such circumstances, no refund or credit will be provided.

17. TRAVEL ADVICE
Adventure Cycling Thailand (ACT) strongly advises you to consult your government’s official travel advice website before embarking on your journey.
18. COMMUNICATION
Adventure Cycling Thailand (ACT) advises all travelers to carry a smartphone with mobile internet capability, ensuring it remains turned on throughout the duration of the trip. We recommend enabling Location Services “At All Times” to facilitate ACT’s ability to provide assistance in case of emergencies.
19. SCHEDULE CHANGES
Adventure Cycling Thailand (ACT) advises you to contact the airline directly to confirm your scheduled departure time 24 hours prior to your flight.
20. CONDUCT

As a participant in our tours, you are expected to adhere to the guidelines set forth by Adventure Cycling Thailand (ACT) to ensure a safe and enjoyable experience for all. By joining our tours, you agree to comply with our instructions, and you acknowledge (in accordance with local laws) that ACT cannot be held liable for any loss or injury resulting from your failure to do so.

It is essential that you familiarize yourself with and uphold the laws, customs, and social norms of the countries you visit during the tour. Your conduct should reflect respect for these regulations and the comfort of fellow travelers, aiming to avoid any disruption or offense. Additionally, you accept responsibility for any damage or loss incurred to the property of ACT or any third party due to your actions.

ACT will not assume liability for any loss or damage suffered by you as a consequence of your non-compliance with local laws, customs, or social expectations while on the tour. You further agree to indemnify ACT (as permitted by local laws) for any third-party claims arising from your actions or failure to adhere to local regulations.

Furthermore, it is mandatory to wear a seatbelt at all times when traveling in any vehicle during the tour. Adventure Cycling Thailand and its affiliates, including directors, shareholders, employees, or agents, cannot be held responsible for any injury, fatality, or claims resulting from accidents if you fail to comply with this requirement.

21. HELMETS

It is mandatory to wear a helmet at all times while cycling with Adventure Cycling Thailand (ACT). Failure to comply with this requirement will result in your exclusion from participating in the cycling portion of the tour program.

Should you opt to utilize your personal helmet instead of the one provided by Adventure Cycling Thailand, you acknowledge and affirm that your helmet adheres to the highest standards of cyclist safety and offers adequate protection for your well-being. Adventure Cycling Thailand and its Affiliates bear no responsibility for any injury, fatality, or claims arising from your non-compliance with this safety protocol.

22. CREDITS & VOUCHERS

In instances where a credit or discount voucher is issued by Adventure Cycling Thailand (ACT), it is important to note that such credits or vouchers hold no cash value and cannot be converted into currency.

ACT Credit, once issued, may be transferred to a friend; however, this transfer can only occur once. It is imperative to utilize all vouchers and credits within the specified expiry period for travel within the subsequent validity period outlined for the voucher.

Should a voucher be redeemed and subsequently cancelled, it will be regarded as if the cancellation occurred during its original validity period. For instance, consider a scenario where a customer possesses a 5,000 THB voucher valid for bookings made within February for a tour commencing in June. If the customer cancels the trip outside the standard 45-day cancellation window, the voucher’s validity period does not extend, and the original validity criteria remain applicable.

23. FEEDBACK

In the event that any aspect of the services arranged by Adventure Cycling Thailand (ACT) falls short of your expectations, we encourage you to promptly bring it to the attention of your tour guide or travel consultant. This allows us the opportunity to address and rectify any issues in a timely manner.

Following the conclusion of your tour, should you wish to provide feedback, we kindly request that it be submitted in writing within 14 days of the tour’s completion. Please note that failure to notify ACT within this timeframe may hinder our ability to thoroughly investigate and address your feedback.

24. PHOTOGRAPHY
During the course of our tours, it is understood that images, photographs, or videos may be captured by fellow participants, Adventure Cycling Thailand (ACT), or our representatives, which may include your likeness. By participating in our tours, you expressly consent to the taking of such pictures and grant ACT and our Affiliates an enduring, royalty-free, global, irrevocable, and fully sub-licensable right to utilize and reproduce your photographic or video likeness for any purpose whatsoever. This includes but is not limited to marketing initiatives, promotional campaigns, and the development of promotional materials, either independently or in collaboration with sublicensees, across various mediums. No compensation or remuneration shall be provided to you for the usage of these materials.
25. OUR ROLE AS AGENT IN CONNECTION WITH THIRD PARTY SERVICE PROVIDERS

Adventure Cycling Thailand (ACT) may engage third-party service providers, such as airlines, transportation operators, accommodations, dining establishments, and excursion providers, to furnish certain components of your booking. While ACT meticulously selects reputable service providers, we must emphasize that we wield no control over, nor bear liability for, the services rendered by these third parties.

Services procured from third-party providers are subject to the respective terms and conditions, encompassing conditions of carriage and limitations of liability, as stipulated by these providers. Your legal recourse pertaining to the provision of travel services by third-party entities is directed towards the specific provider, and, save for instances where our culpability is evident, is not against ACT.

It is important to acknowledge that this clause is universally applicable to all services provided by third parties, regardless of the accompaniment of our tour guide during the provision of such services. Notably, in the event that any travel service provider (excluding instances of our negligence) fails to deliver the contracted services, your recourse lies solely with that provider and not with ACT.

26. MONIES NOT HELD ON TRUST IN CONNECTION WITH THIRD PARTY SERVICE PROVIDERS

All funds remitted by you to Adventure Cycling Thailand (ACT) shall be considered our property and will constitute a debt owed and payable to the respective travel service provider upon fulfillment of the associated services. It is mutually agreed and acknowledged that such funds will not be held by ACT in trust on your behalf.

ACT reserves the prerogative to maintain these funds in any account deemed appropriate, inclusive of our own accounts and/or those designated for customer funds.

27. ROUTE ACCURACY

While every endeavor is made to ensure the accuracy of routes provided, the dynamic nature of road conditions, development, and natural surroundings may render the routes outdated or unsuitably navigable. You consent to the following procedures in the event of inaccuracies or difficulty in locating points of interest:

  1. Proceed to a safe location to troubleshoot the issue.
  2. Conduct a swift assessment of the surroundings and situation.
  3. Utilize alternative resources, including online maps, to identify a suitable alternative route.
  4. If no viable alternative is discernible, promptly contact Adventure Cycling Thailand (ACT) for assistance in devising a suitable solution.

Moreover, while efforts are made to present accurate distances in relevant documentation, variations may occur in distances covered during activities such as hiking, walking, cycling, kayaking, or other means. You acknowledge and agree to be capable of confidently completing every distance provided, plus an additional 20%. For instance, if a tour indicates a daily cycling distance of 100km, you affirm your ability to cover an additional 20%, extending the total distance to 120km if necessary.

28. FLEXIBILITY DURING THE TRIP

While we strive to adhere to the itineraries outlined in our brochures, unforeseen circumstances may necessitate variations to the planned schedule or cause delays beyond our control. Flexibility is paramount in such instances, and your understanding and cooperation are appreciated.

Decisions regarding itinerary adjustments will be made by the tour guide, appointed by Adventure Cycling Thailand (ACT), with the collective well-being of the group in mind. Please be aware that certain sights or activities may not be available on specific trips due to public holidays or other factors.

It’s important to note that no refunds will be provided for services that, for any reason, are not utilized once the trip has commenced. We appreciate your adaptability and understanding as we navigate any unexpected changes to ensure a memorable and enjoyable experience for all travelers.

29. OPTIONAL ACTIVITIES AND EXCURSIONS

Adventure Cycling Thailand (ACT) does not make any representation or warranty regarding implied or explicit suggestions or recommendations for services, activities, and events not expressly included in the trip itinerary provided. You assume all risks associated with transportation to/from and participation in or visitation to any place, activity, or excursion not expressly listed in the trip itinerary as per the provided quote.

During your trip, you may have the opportunity to purchase optional excursions and activities. ACT does not own, operate, or control any of the companies or individuals providing these optional activities or excursions. Should you choose to participate, you must be physically fit and adhere to all reasonable instructions provided.

The health and safety standards followed by the company or individual providing the optional activity or excursion will conform to the regulations of the country where the activity takes place, which may differ from those in your home country. Booking any optional activity or excursion is subject to the operator’s terms and conditions, with your contract governed by local law. ACT acts solely as the agent for these operators.

Adventure Cycling Thailand, its related bodies, corporate directors, shareholders, employees, or agents assume no liability in contract, tort, or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense, or inconvenience directly or indirectly caused by the acts, omissions, or defaults—whether negligent or otherwise—of any operator, their employees, agents, or subcontractors.

30. LIABILITY

Your booking with Adventure Cycling Thailand (ACT) is predicated on your understanding and assumption of the inherent risks associated with travel, including but not limited to:

  • Traveling in undeveloped areas
  • Modes of transportation such as boats, trains, buses, cars, and aircraft
  • Forces of nature
  • Civil unrest
  • Varying levels of sanitation and safety standards
  • Risks associated with food, water, plants, insects, and animals
  • Diseases and transmission of disease
  • Accident or illness in areas with limited medical facilities
  • Acts of government

These risks may be heightened if your tour includes adventure activities or sports like kayaking, cycling, hiking, or climbing. By booking with ACT, you acknowledge and accept these risks, having duly considered this information.

To the extent permitted by law, neither Adventure Cycling Thailand nor any of its related bodies, corporate directors, shareholders, employees, or agents accept liability in contract, tort, or otherwise for any:
(a) Acts or omissions by you or another member of your group;
(b) Acts, omissions, or defaults of third-party providers, over whom ACT has no control (including hotel, activity, and vehicle operators); or
(c) Unavoidable or extraordinary circumstances, as defined above.

Except in cases of death or bodily injury, should ACT or our Affiliates have any liability to you, it is limited (subject to local law) to the price you paid to ACT for your tour. Our liability (including that of our Affiliates) is also limited to the extent that relevant international conventions, such as the Montreal Convention for air travel, the Athens Convention for sea travel, the Berne Convention for rail travel, and the Paris Convention for accommodation, limit the compensation that can be claimed.

Under circumstances where our liability cannot be excluded but may be lawfully limited, such as under applicable consumer laws, our liability is limited to the remedies required by those laws. This liability clause is subject to your rights under applicable consumer laws within Thailand, and nothing in these Booking Terms and Conditions is intended to limit any rights you may have under such laws.

31. COVID-19: IMPORTANT INFORMATION

Adventure Cycling Thailand (ACT) emphasizes the importance of familiarizing yourself with airline and government regulations pertaining to passenger safety and COVID-19. This includes adhering to requirements for presenting evidence of a negative COVID-19 test, both for transit and final destination passengers. As these requirements are subject to change without prior notice, we strongly advise you to stay updated on relevant airline and government policies:

  1. **At Booking:** Familiarize yourself with the current regulations at the time of booking.
  2. **Approaching Travel Date:** Stay informed as you approach your travel date.
  3. **Before Travel:** Immediately before travel, ensure you are aware of any updates or changes.

Airlines, hotels, and other travel service providers are obligated to comply with national and/or local guidelines regarding COVID-19. Consequently, they may implement various measures to ensure compliance, including but not limited to:

  • **Personal Protective Equipment:** Mandating the use of face masks by customers and staff.
  • **Social Distancing:** Implementing measures to maintain safe distances.
  • **Facility Usage Restrictions:** Enforcing limits on the number of individuals in certain areas.
  • **Sanitization Protocols:** Requiring regular hand sanitization.
  • **Entertainment and Food/Drink Services:** Adjusting options to comply with regulations.

It is important to note that while these measures are in place to ensure safety, they are not expected to significantly impact the enjoyment of your trip. All precautions are taken with your safety and that of others in mind.

Local regulations may also necessitate additional measures, such as providing a negative COVID-19 test result, temperature checks, or a health declaration before departure or at specific venues during your trip. Travelers displaying symptoms of illness may be subject to further testing and/or clearance by a medical professional before continuing with the trip. Adventure Cycling Thailand reserves the right to remove any traveler showing symptoms of COVID-19 and unwilling to undergo testing, to mitigate risks to others.

During the trip, customers may be required to wear masks when deemed necessary for safety purposes.

32. COVID-19: OUR LIABILITY

By proceeding with your travel plans, you acknowledge the inherent risks associated with traveling during the COVID-19 pandemic. It is your responsibility to acquaint yourself with all pertinent travel information, including potential health risks. Your decision to travel is made with full awareness of these risks, and you assume personal responsibility accordingly. Adventure Cycling Thailand (ACT) will not be liable for any refunds, compensation, costs, expenses, or other losses incurred by you, including medical expenses, under the following circumstances:

  1. **Failure to Meet Requirements:** If you fail to meet any tests, checks, or other measures mandated by a travel service provider or government body, resulting in denied boarding, entry refusal, or inability to proceed with the trip.
  2. **Positive COVID-19 Test or Close Contact:** If you, or anyone in your group, test positive for COVID-19 or come into close contact with a confirmed case, necessitating quarantine. If such circumstances arise within 14 days of your departure date, you must notify ACT promptly, as you may no longer be able to travel.

Should any of the above situations occur during your trip, please inform ACT immediately. While we will endeavor to provide reasonable assistance, we will not be liable for costs associated with curtailed travel arrangements, missed transportation, additional accommodation, or other related expenses. It is imperative that you have adequate travel insurance with specific COVID-19 coverage to mitigate these potential costs.

Your safety and well-being are of paramount importance to us, and we appreciate your understanding and cooperation in adhering to these guidelines during these challenging times.

33. DATA PROTECTION

At Adventure Cycling Thailand (ACT), safeguarding your personal information is a top priority, and we are committed to handling it with the utmost care and respect in accordance with our Privacy Policy. By entrusting us with your personal information, you agree that our Privacy Policy governs how we handle and process your data, and you consent to ACT collecting, using, and disclosing your personal information as outlined in our Privacy Policy.

Under certain circumstances, ACT may disclose your personal information to entities outside your home country. These may include overseas travel service providers, such as airlines, accommodations, or tour operators, with whom you have made bookings. These service providers typically receive your information in the country where they operate or where their business is headquartered.

Additionally, ACT may share your personal information with our overseas affiliates and service providers who assist us in various administrative and technical capacities. Such disclosures are primarily aimed at facilitating your booking and ensuring the smooth delivery of services.

While we strive to ensure the security of your personal data, once disclosed to any third party, including overseas recipients, you acknowledge that ACT may not be able to enforce compliance with local privacy laws or monitor their handling of your information.

We encourage you to familiarize yourself with the privacy policies of any third-party service providers engaged by ACT on your behalf. In this context, “disclose” encompasses any form of transfer, sharing, transmission, or provision of your personal information to another entity or individual.

34. ACKNOWLEDGEMENT
